Nexartis, LLC ("we," "us," or "our") operates CubiCube®, an AI-powered platform that enables users to build, refine, and deploy web-based applications, storefronts, portfolios, and media hubs without writing code. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our Service.

This policy applies to all users of the platform, including those who build applications ("Operators"), those who create and distribute content ("Creators," "Showrunners," and "Broadcasters"), and end-users who visit and interact with deployed CubiCube® sites.

2. Information We Collect

We collect information in three main ways: information you provide directly to us, information we collect automatically when you use our Service, and information we receive from third parties.

2.1 Information You Provide

  • Account and Identity Information: When you sign up as an Operator, Creator, Showrunner, or Broadcaster, we collect your email address, name, authentication credentials (via Sentinel identity), and role-specific details.
  • Domain Registration: Contact information required for custom domain registration and management.
  • User Content and Prompts: Content you create, upload, or deploy, including the natural language prompts you submit to our AI build flows (e.g., "Build Flows," "Idea Starters," and "One-Shot Recipes").
  • Financial and Monetization Information: If you use our monetization features (e.g., storefronts, tips, subscriptions), we collect information necessary to facilitate payments, payouts, and revenue-sharing splits among Creators, Showrunners, Broadcasters, OCME, and Nexartis.
  • Communications: Messages you send to us, support requests, and interactions within the platform.

2.2 Information Collected Automatically

  • Usage Data: Pages visited, features used (e.g., specific "Cubes" or "Cubis" accessed), prompt history, and actions taken within the platform.
  • Device and Network Information: Browser type, operating system, device identifiers, and network connection details.
  • Log and Telemetry Data: IP address, access times, referring URLs, capability-token streams, and WebSocket link statuses used during secure deployments (e.g., HB3 runtime logs).

2.3 Information from Third Parties

  • Integrations: If you connect your workspace to third-party services (e.g., GitHub, Linear, Stripe), we may receive information from those services as authorized by your settings.

3. How We Use Your Information

We use the information we collect to:

  • Provide and Operate the Service: To deploy your CubiCube® sites, manage Sentinel identities, execute containerized workloads (Ticket Crusher deployments), and facilitate service bindings.
  • Power AI Capabilities: To process your natural language prompts and generate code, layouts, and applications tailored to your requests.
  • Process Payments and Monetization: To facilitate transactions, manage subscriptions, process tips, and calculate and distribute revenue shares in accordance with platform agreements.
  • Manage Domains: To process domain registrations and manage DNS settings.
  • Communicate with You: To send transactional emails, platform updates, and respond to your inquiries.
  • Improve the Service: To monitor and analyze usage patterns, train and refine our AI models (subject to your settings), and develop new features and "Cubes."
  • Ensure Security and Compliance: To detect, prevent, and address technical issues, fraud, illegal activity (such as CSAM), and violations of our Acceptable Use Policy.
  • Comply with Legal Obligations: To satisfy legal and regulatory requirements, including those of our payment processors.

4. Information Sharing

We may share your information with the following categories of third parties:

  • Service Providers: Third parties that help us operate the Service, including hosting providers (e.g., Cloudflare), analytics services, and database infrastructure providers (e.g., D1 databases).
  • Payment Processors: We share transaction and identity information with third-party payment processors (e.g., Stripe) to facilitate payments, ensure compliance with financial regulations, and enforce our Acceptable Use Policy.
  • Domain Registrars: Information required for domain registration as mandated by ICANN.
  • Platform Ecosystem Partners: To facilitate revenue sharing and content distribution, necessary information may be shared among relevant Creators, Showrunners, Broadcasters, and OCME, as defined by platform agreements.
  • Legal and Safety Authorities: When required by law, to protect our rights, or in emergencies. This includes mandatory reporting of Child Sexual Abuse Material (CSAM) to the National Center for Missing and Exploited Children (NCMEC) and relevant law enforcement.
  • Business Transfers: In connection with a merger, acquisition, or sale of assets.

5. Data Security

We implement robust technical and organizational measures to protect your information, including Sentinel identity protections, encrypted GitHub/Linear connections, and secure Cloudflare service bindings. However, no method of transmission over the Internet is 100% secure, and we cannot guarantee absolute security.

6. Data Retention

We retain your information for as long as your account is active, your CubiCube deployments remain live, or as needed to provide the Service. We may retain certain information as required by law, for legitimate business purposes, or to resolve disputes.

7. Your Rights and Choices

Depending on your location, you may have the right to:

  • Access the personal information we hold about you.
  • Request correction of inaccurate information.
  • Request deletion of your information.
  • Object to or restrict certain processing.
  • Data portability.

8. Cookies and Tracking

We use cookies and similar technologies to enhance your experience, analyze usage, and provide authentication. You can control your analytics, advertising, and functional cookie consent through the Privacy Center on our website.

9. Children's Privacy

The Service is not intended for children under 13. We do not knowingly collect information from children under 13. If we learn we have collected such information, we will delete it.

10. International Transfers

Your information may be transferred to and processed in countries other than your own. We ensure appropriate safeguards are in place for such transfers in compliance with applicable data protection laws.

11. Changes to This Policy
