This Acceptable Use Policy ("AUP") outlines the rules and guidelines for acceptable conduct when using the CubiCube platform, including all associated websites, applications, AI development tools, and services (collectively, the "Service"). This AUP applies to all users of the platform, including those building applications, creating content, distributing media, and end-users interacting with deployed projects.
By accessing or using CubiCube, you agree to comply with this AUP. Nexartis, LLC ("Nexartis"), the owner of CubiCube, reserves the right to enforce this policy through content removal, project takedown, account suspension, or termination, and by reporting violations to law enforcement or relevant third-party service providers.
1. Prohibited Content and Activities
Nexartis, through CubiCube, is committed to maintaining a safe, legal, and respectful environment for all users. You may not use our Service—including our AI generation tools ("Build Flows," "Idea Starters," and "One-Shot Recipes")—to create, upload, post, stream, distribute, or otherwise transmit any content, or engage in any activity, that falls into the following prohibited categories.
1.1 Illegal Acts and Harmful Content
You must not use CubiCube for any unlawful purposes or to promote illegal activities. Prohibited content includes, but is not limited to:
- Child Sexual Abuse Material (CSAM): Any content depicting the sexual exploitation or abuse of minors. CubiCube has a zero-tolerance policy for CSAM. All instances will be immediately reported to the National Center for Missing and Exploited Children (NCMEC) and relevant law enforcement agencies.
- Violence and Incitement: Content that engages in, encourages, promotes, or celebrates unlawful violence, physical harm, or self-harm.
- Hate Speech and Harassment: Content that engages in, encourages, promotes, or celebrates unlawful violence or severe harassment toward any group based on race, religion, disability, gender, sexual orientation, national origin, or any other immutable characteristic.
- Terrorism: Content that promotes or supports terrorist organizations or their activities.
- Illegal Goods and Services: Content promoting the sale or use of illegal drugs, unauthorized weapons, explosives, or other dangerous materials.
1.2 Adult Content and Services
In compliance with our payment processing partners, Nexartis strictly prohibits the distribution or monetization of adult content. Prohibited content includes:
- Pornography and other sexually explicit materials (including literature, imagery, and other media) designed for the purpose of sexual gratification.
- Promotion of adult services, including prostitution, escorts, pay-per-view sexual content, sexual massages, and adult live-chat features.
- Any artificial intelligence-generated content that meets the above criteria.
1.3 Intellectual Property Infringement
You may only upload or generate content that you have the right to use and share. Prohibited activities include:
- Sales or distribution of music, movies, software, or any other licensed materials without appropriate authorization.
- Uploading counterfeit goods or unauthorized brand-name products.
- Using AI tools to intentionally replicate or bypass the copyright protections of third-party works.
- Any other content that directly infringes or facilitates infringement upon the trademark, patent, copyright, trade secrets, proprietary, or privacy rights of any third party.
- Note: Nexartis complies with the Digital Millennium Copyright Act (DMCA) and will remove infringing content upon receipt of a valid takedown notice.
1.4 Fraud, Deception, and Exploitation
You must not use CubiCube to engage in unfair, deceptive, or abusive acts or practices. This includes:
- Pyramid schemes, multilevel marketing, or "get rich quick" schemes.
- Phishing, scamming, or attempting to obtain sensitive personal or financial information from other users.
- Selling fake references, ID-providing services, or document falsification services.
- Impersonating another person, brand, or organization in a misleading or deceptive manner.
- Deploying applications designed to maliciously scrape data or deceive end-users.
1.5 Financial and Regulated Services Restrictions
CubiCube cannot be used to facilitate transactions for restricted financial products or highly regulated industries without explicit prior approval. This includes:
- Peer-to-peer money transmission outside of the platform's standard monetization features.
- Cryptocurrency mining, staking, or Initial Coin Offerings (ICOs).
- Unregulated gambling, lotteries, or games of chance with monetary prizes.
- Sales of restricted items such as tobacco, e-cigarettes, or pharmaceutical products.
1.6 System Abuse and Interference
You must not use the Service in a way that disrupts or compromises its integrity. Prohibited activities include:
- Attempting to bypass, exploit, or reverse-engineer the Service's AI models, security controls, or usage limits.
- Deploying applications ("Cubis") that execute denial-of-service (DoS) attacks, distribute malware, or engage in unauthorized network scanning.
- Using automated scripts or bots to artificially inflate metrics, bypass rate limits, or scrape platform data.
2. Platform Roles and Responsibilities
Nexartis operates with a unique ecosystem involving application Operators, Creators, Showrunners, and Broadcasters. Each role carries specific responsibilities regarding content compliance.
- Operators: Users who build and deploy applications ("Cubis") are responsible for ensuring that their deployed projects, including any user-generated content hosted within them, comply with this AUP.
- Creators: Responsible for ensuring that all uploaded video or media content strictly adheres to this AUP. Creators must hold the necessary rights to their content and must not attempt to monetize prohibited material.
- Showrunners: Responsible for aggregating and packaging content into shows. Showrunners must exercise due diligence and not knowingly include violative content in their programming. Showrunners are expected to utilize platform tools to report violations by Creators.
- Broadcasters: Responsible for the distribution of shows. Broadcasters must monitor the content they distribute and immediately cease distribution of any show found to violate this AUP.
3. Content Moderation, Detection, and Removal
To ensure compliance with this AUP and the requirements of our financial partners (including Stripe), Nexartis employs a comprehensive moderation strategy across both AI generation inputs/outputs and deployed content.
3.1 Detection Mechanisms
Nexartis utilizes a combination of automated systems and human review:
- Automated Screening: Uploaded content, natural language prompts, and AI-generated outputs are subject to automated scanning to detect known copyrighted material, explicit imagery, and high-risk keywords.
- Human Review: A dedicated Trust and Safety team conducts manual reviews of flagged content, deployed projects, appeals, and accounts exhibiting high-risk behavior.
- User Reporting: Nexartis provides accessible reporting tools for all users to flag content or deployed applications that they believe violate this AUP.
3.2 Removal and Enforcement Actions
If Nexartis detects or is made aware of content or activity that violates this AUP, we will take swift action, which may include:
- Content/Project Removal: Immediate removal or disabling of access to the violative content, or taking down the offending deployed application ("Cubi").
- Demonetization: Suspending or revoking the ability to receive payments, tips, or revenue shares associated with the violative content or the offending account.
- Account Suspension/Termination: Temporary suspension or permanent termination of the user's account.
- Law Enforcement Reporting: Reporting illegal activities, particularly those involving CSAM or terrorism, to the appropriate authorities.
3.3 Appeals Process
Users whose content is removed, projects taken down, or whose accounts are suspended may have the right to appeal the decision. Appeals are reviewed by the Trust and Safety team to ensure enforcement actions were applied accurately according to this AUP.
4. Compliance with Payment Processors
Nexartis utilizes third-party payment processors, including Stripe, to facilitate transactions, tips, and revenue sharing. By using CubiCube's monetization features, you agree that:
- Your use of the platform must comply with the Stripe Services Agreement and Stripe's Prohibited and Restricted Businesses List.
- Nexartis is required to monitor platform activity and may share information regarding AUP violations, fraud, or illegal activity with Stripe to maintain platform integrity and comply with financial regulations.
- Nexartis reserves the right to withhold payouts, reverse transactions, or refund viewers/users if funds were generated through content or applications that violate this AUP or our payment processor's terms.
5. Modifications to this Policy
Nexartis reserves the right to modify this Acceptable Use Policy at any time. We will notify users of significant changes through the platform or via email. Continued use of the Service after such modifications constitutes your acceptance of the updated AUP.
